The laws governing fire risk have been tightened considerably. Under the Fire Safety Order 2005 it is now a requirement that for a non-domestic building, a ‘responsible person’ (usually the owner, employer or occupier) must carry out a fire risk assessment and implement a fire management plan.

What are my legal obligations?

Current law stipulates that you must keep a written record of your fire risk assessment if your business has 5 or more people. The fire risk assessment will need to highlight any fire risks in your property or business.

More importantly, it then needs to make recommendations to make your premises safe. All of this information then needs to be finalised in a written fire risk assessment report.

Is Your Fire Risk Assessment Up To Date?

There is no stipulation in law as to the exact timescales that your fire risk assessment should be reviewed. It does, however, clearly state that your fire risk assessment should be reviewed regularly by the responsible person for assessments in your premises. As a guide, we recommend that you should review your fire risk assessment :

  • Every 12 months from the original date of completion
  • If the premise the fire risk assessment pertains to has changed its purpose significantly
  • After any change of structure or layout to the premises
  • If the general occupancy of the premises has changed significantly

In reality, for your safety and to remain compliant with the Fire Safety Order 2005, we would advise a fire risk assessment review at least every 12 months AND conduct a brand new fire risk assessment every 5 years. This will ensure that any changes within your premises that would have an effect on your fire safety provisions (e.g. extending the floor space, refurbishments or change of purpose) have been accounted for and suitably mitigated against.
